Acknowledgment of Risk of Participation

This is an important document: You must read it before agreeing:


  1. I acknowledge that this Acknowledgement of Risk and Conditions of Participation applies to all Activities I am taking part in at Stubbers Adventure Centre and is valid for 12 months from the date of signing. 

  2. I wish to participate in the Adventure/s (the “Activities”) organised by Stubbers Adventure Centre (the “Company”). 

  3. I declare that I am 18 years or older. 

  4. I consent to allow any child(ren) under my supervision to participate in the Activities. I acknowledge the risk on their behalf and will ensure they comply with the conditions of participation detailed below. I confirm they are of at least the minimum age to participate and that I am the parent or guardian or otherwise that I am authorised to sign this Waiver. 

  5. I agree that I and those under my supervision will undertake the Activities in accordance with the specific oral and written instructions and advice to be given before undertaking the or during the Adventures, failure to do so may result in serious injury or death. 

  6. I agree that I will indemnify and hold harmless the Company from any costs, expenses, loss, liability, damages or costs that may arise as the result of or in connection with or resulting from my failure or the failure of those under my supervision to adhere to the foregoing paragraph. 

  7. I acknowledge that participants in the Activities should be in good health and declare that to the best of my knowledge neither I or those under my supervision have a medical condition which is likely to increase the chance that I am or they are involved in an incident, resulting in injury to myself, themselves or others. I further declare that if I or anyone under my supervision is pregnant I have gained permission from a medical professional to participate in the Activities.  

  8. I understand that the Activities require some physical effort, are psychologically challenging and involve risks or dangers. I, on behalf of myself and those under my supervision, accept that there is a risk of injury when undertaking such adventures. 

  9. I understand, on behalf of myself and those under my supervision, and accept that the nature of the Activities may result in damage to clothing. 

  10. I understand and accept, on behalf of myself and those under my supervision, that I shall be responsible for my own safety for self-led and free play activities e.g. Play Park and Discovery Trail. And undertake to the Company and other participants that I shall conduct the Adventures in a responsible manner. 

  11. I understand that for safety reasons, the maximum weight for an individual on the Activities Abseiling, Climbing, Crate Stack, High Ropes, Pamper Pole, Vertical Obstacle Course and Mountain Boarding is 114kg (17 stone) and warrant that I and those under my supervision do not exceed this weight. 

  12. In the unlikely event of an accident occasioning bodily injury, or loss, or damage to my personal effects, I acknowledge that the Company will not be liable for any direct or indirect loss, damage or injury arising from or in connection with the Activities (except for death or personal injury caused by the Company’s negligence) and I will waive all and any claims that I or those under my supervision may have, against the Company in this respect. I also indemnify and hold harmless the Company from any claims, direct or indirect loss, damage or injury arising from or in connection with my acts or omissions or those of persons under my supervision. 

  13. I acknowledge and agree that the Company shall have the right to suspend or cancel my participation or the participation of those under my supervision before, or during the Activities in the event of suspected  intoxication, non-compliance with these conditions, reckless or careless behaviour, threatening behaviour, verbal abuse and harassment or other behaviours that prejudice the safety and mental well being of other park users and staff

  14. Covid-19 has been declared as a global pandemic by the World Health Organisation and it is believed to spread mainly from person to person contact. As a result, and following UK government recommendations, Stubbers Adventure Centre has put in place preventative measures to reduce the spread of Covid-19 and by signing, you and your group, agree to follow all protocols; however, Stubbers Adventure Centre cannot guarantee that you or your group will not become infected with Covid-19. By signing this waiver, I acknowledge the contagious nature of Covid-19 and voluntarily assume the risk this may pose to myself, my family and my group.  

Terms of Booking

Confirmation:

Once you have received your receipt (normally via email), this is confirmation of your booking. Please check all details on the invoice including date, activity and particpant  name, and notify us immediately if any details are incorrect.

Child care vouchers:

Childcare vouchers are accepted for Ofsted registeredFull Payment must be made at the time of booking. If paying by an agreed child care voucher provider, your booking isn’t confirmed until we receive the payment. Please allow up to 5 working days for child care vouchers to reach us and use your Customer ID as a reference.


Cancellations:

For individuals, groups of individuals and Birthday Party bookings full refunds may  be given if we are notified one working day before the reservation. If you wish to cancel your booking, you must notify us immediately in writing to info@stubbers.co.uk. Until confirmation is received we will continue to hold your reservation. All cancellations will be acknowledged.

If cancellation is due to illness, a full refund may be given with less than 24 hours notice, subject to the illness being medically certified. There is a £5 admin charge with any cancellation.

Exclusions:

Stubbers reserves the right to exclude from activity or the site or refuse any person at any time if, in our opinion, the person’s behaviour is unsafe or spoiling the enjoyment for other site users or otherwise not in accordance with site rules. No refund will be given.

We do not knowingly allow anyone to use or visit our centre who is a convicted child sex offender or subject to the notification requirements of the Sexual Offences Act 2003, or subject to a Sexual Risk Order or Child Abduction Notice.

Personal property:

Your personal effects are your responsibility at all times, unless any loss or damage is due to negligence or failure in our procedure. We recommend that you take out personal effects insurance.

Lost property:

This is disposed of weekly. Wet or very dirty clothes are disposed of daily. Valuables and small items will be kept for 4 weeks and, if not claimed, will be disposed into the Stubbers Charitable Bursary fund.

Photography and video footage:

Please note that we use photos or videos taken by authorised personnel for inclusion in promotional material including our website. Please inform us on booking if you or your group do not wish your photo to be taken.

Dogs:

We regret that pets other than guide dogs are not permitted on site.

Smoking, alcohol and drugs:

In compliance with the law, smoking is not permitted in buildings, shelters, tents and activity areas. People over 18 years of age are not permitted to smoke on site other than in a designated outside area.

No person will be permitted to take part in activities if in the opinion of Stubbers staff that individual may be under the influence of alcohol or drugs. Consumption of alcohol on-site is at the discretion of the management. However, we do not expect young people to be given access to alcohol during their visit.

Customer feedback:

If you have any feedback during your visit please inform Guest Services on-site who will endeavour to help you. If the matter is not dealt with to your satisfaction, please email info@stubbers.co.uk within 28 days of the end of your visit. Failure to follow this simple procedure may prevent a full investigation of the points that you raise.

We cannot therefore accept liability for any complaint or claim that is not reported in accordance with this procedure unless the claim or complaint involves death, personal injury or illness.

Risk assessments:

Copies of our standard operating procedures and risk assessments can be made available on request.

Insurance cover and liability:

Stubbers Adventure Centre has a £10 million public indemnity and liability insurance. Stubbers Adventure Centre does not accept liability for personal injury or loss or damage unless there is proven negligence of the company or their employees.

Accidents:

Adventurous Activities by their nature carry an element of risk of death or injury. All persons that agree to take part in activities at the centre do so at the acceptance of that risk. It is the responsibility of the parent/carer to ensure that all members of the party understand and accept the risks involved and that, in the case of young people, parental permission has been obtained.

This acceptance of responsibility however is subject to all of our booking conditions. We cannot accept liability where the death, personal injury or illness was due to the act(s) and / or omission(s) of the person(s) affected, or where we or the supplier of the service in question could not have foreseen an event or avoided it even with all due care.

Pregnancy policy:

Due to the nature and risk of the adventurous activities we provide, we are unable to advise on participation if you are pregnant. The welfare of mother and baby is our highest priority – as every pregnancy is different and each mother will be given different care plan, we suggest you seek advice from your doctor before attempting participation.

In order to assist your doctor, we have an adaption form detailing the activity descriptions and risks involved in each activity. This should be used with the risk-benefit analysis for the centre which is available on our website. This is available on request and will help them make an informed judgement.

All activities taken part in are at your own risk. Under 18 year olds are unable to opt-out of our advice and participation will not be permitted without the form completed by a medical professional.
